Terms and Conditions

This Hackathon participation agreement (“Agreement“) constitutes a legally binding contract between you (“you” or “Participant“), your team (“your team” or “Participant Team”) and Singapore Blockchain Innovation Programme (SBIP) (“organiser” or “SBIP”) as the Organiser and applies to you and your team’s participation in the Singapore Blockchain Innovation Challenge 2021 (“Hackathon“) to be held virtually from 17 July 2021 to 31 July 2021. By registering for and participating in the Hackathon, you acknowledge: (i) to have read, understood, and agree to be bound by the Terms & Conditions in this Agreement, and any other guidelines or instructions provided to you by the Organiser; (ii) to comply with all applicable laws; and (iii) to be bound by the decisions of the Organiser, which decisions are final and binding. To the extent that there is any discrepancy or inconsistency between this Agreement and any disclosures or other statements contained in any Organiser’s materials, this Agreement shall govern.

Article 1. Definitions

  • "Singapore Blockchain Innovation Programme” or “SBIP” or “Organiser” shall mean Singapore Blockchain Innovation Programme (SBIP). SBIP is a national-level technical collaboration community that was launched in December 2020, supported by the Singapore government and anchored at National University of Singapore (NUS), situated at 21 Lower Kent Ridge Road, Singapore (119077).
  • “Agreement” shall mean the set of Terms & Conditions detailed for the Singapore Blockchain Innovation Challenge 2021.
  • “Hackathon” shall mean the Singapore Blockchain Innovation Challenge 2021.
  • “Finalists” shall mean the Participant Teams who have qualified for the “Grand Finale Round” on 31 July 2021.
  • “Participant” shall mean any eligible legal person who has registered to participate in either the Company or Enthusiast track of the Hackathon.
  • “Participant Team” shall mean a group of minimum two (2) Participants and no more than four (4) Participants working on a single Submission.
  • “Event Website” shall mean the official event website for the Singapore Blockchain Innovation Challenge 2021, hosted at the website domain https://www.sbip.sg.
  • “Submission” shall mean the list of original submission(s) (e.g. proposal, prototypes, pitch video, pitch deck) submitted by each Participant Team, as set out in Article 6.

Article 2. Eligibility Criteria

  • 2.1 The Hackathon comprises of the following tracks:

    • Corporate Track
    • Enthusiast Track
  • 2.2 Under the Hackathon, the following terms shall apply:

    • Only companies registered with the Accounting and Corporate Regulatory Authority (ACRA) are allowed to participate in the Corporate Track.
    • All employees (including full-time and part-time employees) of the Organiser, employees of sponsors and partners of the Hackathon are not eligible to participate in the Hackathon in any of the tracks listed in Article 2.1.
    • The Organiser reserves the right to assess each Participant’s eligibility and compliance with the Agreement at any point during the Hackathon. Participants must promptly respond with any necessary evidence to verify their eligibility upon the Organiser’s request. The Organiser reserves the right to refuse entry to any Participant, and shall not be obliged to provide any explanations thereof.

Article 3. Registration and Access to the Hackathon

  • 3.1 In order to register for the Hackathon, the team lead of each Participant Team must complete the following registration information:

    • Team Name
    • Hackathon Track
    • Company Name (required only if "Corporate Track" is selected)
    • ACRA Registration Number (required only if "Corporate Track" is selected)
    • Email Address of Team Lead
    • Contact Number of Team Lead
    • Number of Team Members (limited to 2-4 members per team, including Team Lead), and details of each Participant:
      • Name
      • Age
      • Email Address
      • Contact Number
      • School/Institute
      • Citizenship (Singapore Citizen / Singapore Permanent Resident (PR) / Long-Term Visa Holder)
      • T-Shirt Size
    • Consent on Terms & Conditions [Agreement]
    • Consent on Collection, Use and/or Disclosure of Information / Personal Data [Privacy Policy]
    • Other Attachments (e.g. Consent Forms for Participants below the age of 21)
  • 3.2 Registration for the Hackathon will start on 23 June 2021 0900hrs (GMT+8) and will end on 15 July 2021 2359hrs (GMT+8).
  • 3.3 Participants below the age of 21 are required to fill in a consent form and have it uploaded as part of the registration process.
  • 3.4 For successful registrations, a confirmation email will be sent to the email address of the team lead listed in the registration form. Incomplete registration forms will not be accepted and such applicants will not be registered for the Hackathon.
  • 3.5 Participants are not allowed to register in both tracks of the Hackathon. Specifically, a participant who has registered for the “Corporate Track” should not register for the “Enthusiast Track” and vice-versa. Any Participant who failed to adhere to this requirement will result in immediate disqualification from the Hackathon.
  • 3.6 Participation in the Hackathon is free of charge and no Participants will be obliged to pay a registration fee or any other associated fee(s) to the Organiser in connection with his/her participation in the Hackathon.
  • 3.7 The Hackathon will be accessible on the Event Website for the duration of the Hackathon, subject to possible maintenance operations on servers or dysfunctions.

Article 4. Duration of the Hackathon

  • 4.1 The Hackathon will take place virtually for the period of 17 July 2021 to 31 July 2021.
  • 4.2 All dates and times referred to in this Agreement, the Event Website and in any documents relating to or in connection with the Hackathon, shall be in the Singapore time zone (GMT+8).
  • 4.3 The Organiser reserves the right to alter the duration of individual rounds of the Hackathon at any time, without providing any justification. Such amendments will be communicated to the Participants prior to such change.

Article 5. Selection Process and Judging Criteria

  • 5.1 The Hackathon is divided into 3 rounds:

    1. The first round is the “Proposal Submission Round” where Participant Teams are required to submit their proposal by 20 July 2021 (23:59 hrs, SGT).
    2. The second round is the “Selection Round” on 27 July 2021, where Participant Teams are required to pitch their solution to the Organiser. Submissions will be evaluated by one or more panels of judges selected by the Organiser (“Judging Panel”). Any changes to the Judging Panel shall be determined in the sole discretion of the Organiser. Successful Participant Teams shall proceed to the final “Grand Finale Round” and will receive mentoring and guidance from technical experts for the purpose of fine-tuning their proposed prototypes.
    3. The third and final round is the “Grand Finale Round” where shortlisted Participant Teams who have been selected during the “Selection Round” are required to present their final prototypes and pitch deck to the Judging Panel.
  • 5.2 The evaluation judging criteria for eligible submissions for the “Selection Round” include:

    • Originality
    • Business Value & Relevancy
    • Innovation & Creativity
    • Operational Feasibility & Scalability
    • Quality of Pitch Delivery
  • 5.3 The evaluation judging criteria for eligible submissions for the “Grand Finale Round” include:

    • Originality
    • Business Value & Relevancy
    • Innovation & Creativity
    • Operational Feasibility & Scalability
    • Quality of Pitch Delivery
    • Technical Competency
    • User Experience
  • 5.4 There will be a prize awarded for the best-liked Submission across the two tracks. The evaluation criteria for the best-liked Submission will be based on the highest vote count in the “Grand Finale Round”.
  • 5.5 The judging criteria may change at the Organiser’s discretion. Any such changes will be updated on the Event Website. Participants are advised to check the Event Website periodically to keep updated of any latest changes.
  • 5.6 Participants and their Submissions must comply fully with the Terms & Conditions stated in this Agreement in order to be eligible for being selected as the winners. The Organiser reserves the right to disqualify any Participant, Participant Team, and/or Submission that does not comply with any of the Terms & Conditions, or for any reason the Organiser deems fit, including but not limited to Submissions which contain inaccurate, invalid or misleading information.
  • 5.7 Any Participant submissions deemed by the Judging Panel to be obscene, incendiary, defamatory, sexually explicit, or otherwise objectionable or inappropriate will not be considered for the Hackathon. The Organiser and the Judging Panel reserve absolute discretion to determine the acceptability of such work or Submissions.
  • 5.8 Participants must not communicate with or attempt to influence the Judging Panel. Failure to adhere to this requirement may result in disqualification of the relevant Participant and/or Participant Team.
  • 5.9 Eligible Participants whose Submission earns the highest overall score based on the judging criteria in the “Grand Finale Round” may be selected as the winner.
  • 5.10 Prior to the “Selection Round”, Participant Teams are encouraged to submit their proposal by 20 July 2021. The Organiser will inform all Participants of the “Selection Round” results by 28 July 2021, or any amended date in line with this article. Such notification will be carried out via an email sent to the email address of the team lead of each Participant Team provided in the registration form. The Organiser reserves the right to change the date of release of the results, and such changes will be updated on the Event Website.
  • 5.11 Prior to the “Grand Finale Round”, Participant Teams are required to submit their final prototypes and pitch deck by 30 July 2021 before the commencement of the “Grand Finale Round” on 31 July 2021. Failure to adhere to this requirement may result in disqualification of the relevant Participant Team.
  • 5.12 The results of the “Grand Finale Round” will be announced on 31 July 2021, the day of the “Grand Finale Round”. In the event of a tie, the Judging Panel will deliberate to determine the winning Participant Team.

Article 6. Submission Requirements and Disqualification Criteria

  • 6.1 A Participant Team’s Submission may be disqualified if the Organiser has/have reason(s) to believe, in the Organiser’s sole discretion, that the Participant Team’s Submission:

    • Contains any content(s) that is/are inappropriate, obscene, racist, and/or offensive;
    • Contains any element(s) that is/are malicious, corrupted, and/or destructive;
    • Violates the terms of use of any social media service, website, mobile application, or any other platform used in connection with the Participant Team’s Submission;
    • Violates any third party IP rights or applicable license terms;
    • Violates any applicable law; or
    • Violates or does not comply with any of the Terms & Conditions stated in this Agreement.
  • 6.2 All Submissions must adhere to the following requirements:

    • Be original work owned by the Participant(s), or duly licensed by the owner of such work to the Participants, providing the Participants the rights to distribute and modify the contents for the purpose of the Hackathon for both the “Selection Round” and the “Grand Finale Round”; and
    • Not violate or infringe upon any IP Rights or proprietary right or other rights including but not limited to contract, copyright, patent, trademark, open-source license permissions, and/or privacy rights, of any other person or entity.
  • 6.3 In creating or developing their prototype, Participants may use Application Program Interface (“API”) that have been provided for the Hackathon, and/or APIs, libraries, software development kits (“SDKs”) and other tools which are available and authorized for public use.
  • 6.4 Majority of source code developed as part of the Hackathon should be original. Specifically, the portion of the source code for the proposed prototype that is included in the source code repository has been developed explicitly for the Hackathon.
  • 6.5 For the Enthusiast track, all the source codes and existing libraries (including third-party APIs and SDKs) must be open-source and publicly available to all Participants. For the Corporate track, Participant Teams are allowed to make use of additional libraries (e.g. in-house and/or privately developed APIs), in addition to the requirements stated in Clauses 6.3 and 6.4. Hence, participants teams under the Corporate track will be graded using a more stringent judging criteria.
  • 6.6 All Submissions must be sent in a common digital format (pdf, avi, mov, mp4, zip, rar) and must be in the English language.
  • 6.7 In the event where the Organiser is unable to read the Submission, Participants of the concerned Submission will be notified through the email of their team lead and will be required to re-submit the Submission before the relevant deadline.
  • 6.8 If a prototype is submitted and the prototype requires any additional third party software to function, Participants must provide the Organiser with access to and use of such additional software at no cost to the Organiser.
  • 6.9 Participants may only use APIs, data or any additional tools to the extent that they have been authorized to use them. Tools authorized for public use refers to those that:
    • have been made publicly available on the internet to date; and
    • are searchable through common search engines, and accessible thereafter either free or with authorized access.
  • 6.10 Each prototype may include the use of open source software, provided that:
    • the Participants comply with applicable open source licenses; and
    • that the applicable open source license terms will not require the subsequent release, disclosure or distribution of any part of the prototype back to the open source community or to any third party under any circumstances.
  • 6.11 Each submitted prototype must not have been developed, or derived from any software developed, with any support or in conjunction with any third party in contract with the Organiser. The Organiser may in their sole discretion disqualify a Submission if, in the Organiser’s opinion, awarding a prize for that Submission creates any conflict of interest.
  • 6.12 Participants must ensure that their Submission can be successfully installed on and is able to function on the respective mobile devices or desktop/laptop computers for which they were designed to be used on.
  • 6.13 Participants shall not make available or disclose any Submission to the public.

Article 7. Prizes, Winners, and Usage of Prizes

  • 7.1 All Participants who have registered for the Hackathon and have taken part in the “Selection Round” will be given an event t-shirt and a Certificate of Participation.
  • 7.2 There will be prizes awarded for each track, and a separate prize will be awarded for the best-liked Submission across the two tracks.
  • 7.3 The Organiser reserves the right to at any time, in their absolute discretion, cancel or modify the Hackathon, substitute or withdraw any prize without prior notice, without having to disclose any reason therefore, and without any form of payment or compensation whatsoever.
  • 7.4 The Organiser reserves the right not to award any prize. The decision of the Organiser shall be final and conclusive, and no correspondence will be entertained.
  • 7.5 All prizes must be claimed from the Organiser by the winning Participant Teams within two months from the date of the “Grand Finale Round”, otherwise all unclaimed prizes will be forfeited at the sole and absolute discretion of the Organiser. The Organiser and the Judging Panel shall not be obliged to award any prize to any winning Participant Teams beyond the stipulated collection period.
  • 7.6 By accepting the prize, each winning Participant Team agrees to participate in all reasonable media publicity relating to the prize prior to the collection of the prize, and also after the prize has been collected. This includes being featured in social media promotions and may include posts on each winning Participant Team’s own personal social media platforms, as guided by the Organiser.
  • 7.7 The Organiser shall not be liable for any claims, losses, damages, injuries, costs and, expenses suffered, sustained, or incurred (including but not limited to, indirect, consequential loss including death) or costs incurred due to unforeseen circumstances as a result of, or arising out of, or in any way connected with the Hackathon and the prize.

Article 8. Intellectual Property

  • 8.1 All materials including software, source code, documentation, data, concepts and ideas (whether created or developed independently by a Participant or jointly with others) submitted to the Organiser shall be the property of the Participants. For the avoidance of doubt, employees of the Organiser involved in the organization of the Hackathon shall under no circumstances be entitled to claim any rights, including Intellectual Property (IP) rights, for their Submissions. Notwithstanding anything to the contrary herein, each Participant acknowledges and agrees that the Organiser may use, incorporate or disclose any ideas or concepts related to the Submission now or in the future in any manner, and each Participant waives any and all claims that may arise against the Organiser or anyone else participating or otherwise attending in the Hackathon for such use or disclosure.
  • 8.2 By participating in the Hackathon, each participant acknowledges and agrees that all IP rights contained within the APIs or SDKs ("Partner APIs") that have been made available to the participants for the purpose of creating or developing the proposal prototype, shall remain vested in the owner of such Partner APIs.
  • 8.3 By making a Submission, each Participant acknowledges and agrees that the Organiser may obtain many Submissions in connection with the Hackathon and/or other marketing initiative(s) or challenge statement(s) staged and/or offered by the Organiser (“Submitted Ideas”), and that such Submissions may be similar or identical in theme, idea, format or other respects to other submitted Ideas or other materials developed by the Organiser. Unless prohibited by law, each Participant waives any and all claims against the Organiser and/or any other Participants (or Participant Teams) the Organiser may have had and/or may have (presently or in the future), that any Submission and/or other works (including videos) accepted, reviewed and/or used by the Organiser or other Participants may be similar to his/her Submission, or any compensation that is due to such Participant in connection with such Submission or other works used by the Organiser.
  • 8.4 Subject to Clause 8.1 herein, each Participant hereby grants to the Organiser a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to access and use the Submission in whole or in part (as defined in Article 5 and 6) for the sole purpose of evaluating the Participant Teams during the Hackathon.
  • 8.5 By participating in the Hackathon and submitting a proposal, participants hereby agree to allow the Organiser to contact them for any clarifications about their proposals, and offer the Organiser to use, discuss, and distribute the contents within their proposal.
  • 8.6 Participants are not granted the permission to use or display any of the Organiser’s trademarks (e.g. logo) or rights in any form after the Hackathon without the prior written consent of the Organiser. Participants agree to provide prior written notice of 7 working days to the Organiser prior to promoting or publicising their participation or activities related to the Hackathon.
  • 8.7 None of the Terms & Conditions listed in this Agreement is intended to grant Participants with any rights to use any of the Organiser’s IP, except being explicitly stated otherwise in this Agreement.

Article 9. Indemnity and Exclusions of Liability

  • 9.1 While reasonable care will be taken for the Submissions provided to the Organiser, the Organiser assumes no responsibility for any loss of or damage to the Submissions before, during, and/or after the Hackathon.
  • 9.2 The Organiser shall have no liability in connection with the following circumstances:
    • Any incorrect or inaccurate information, whether caused by the Organiser's system-related issues, or by any of the equipment or programming associated with or utilised in the Hackathon;
    • Technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, internet connectivity or electronic transmission errors, or network hardware or software or failure of the Event Website;
    • Technical or human error which may occur in the administration of the Hackathon or the processing of Submissions; or
    • Unauthorized human intervention in any part of the entry process or the Hackathon.
  • 9.3 The Organiser is not responsible for any incomplete, late, misdirected, damaged, lost, illegible, or incomprehensible Submission or for changes of email address of the Participants. Proof of sending or submitting any Submission or other material shall not be deemed to be proof of receipt by the Organiser.
  • 9.4 If for any reason any Submission is determined to have not been received or been erroneously deleted, lost, or otherwise destroyed or corrupted, the Participant’s sole remedy is to request from the Organiser the opportunity to resubmit the Submission. Such a request must be made promptly after the Participant becomes aware or should have been aware of such an issue, and the result of which shall be determined by the Organiser in their sole discretion.
  • 9.5 Participants agree that no claim shall be asserted against the Organiser, their sponsors and partners, as well as any other associated organization(s) responsible for sponsoring, fulfilling, administering, advertising, or promoting the Hackathon, and all of their respective past and present agents, officers, directors, employees, and representatives, for any and all losses (including special, indirect and consequential losses), injuries, damages, rights, claims and actions of any kind in connection with the Hackathon and/or the acceptance of any prize, including without limitation, personal injuries, death and property damage. To the maximum extent permitted by law, without prejudice to the generality of the foregoing, Participants agree to release the Organiser, their sponsors and partners, as well as any other associated organization(s) responsible for sponsoring, fulfilling, administering, advertising, or promoting the Hackathon from and against any claim or cause of action in connection with the Participants’ participation in the Hackathon, including, but not limited to:
    • Technical errors that may impair the Participants’ ability to participate in the Hackathon;
    • Errors that occurred during the administration of the Hackathon;
    • Any claim or allegation that the Participants’ participation in the Hackathon, or any Submission was in violation of the Terms & Conditions stated in this Agreement, or that the Agreement infringes any IP Right;
    • Claims relating to damage to persons or property in connection with the Hackathon;
    • Disputes amongst Participants in teams; and
    • Unauthorized human intervention in the Hackathon;
  • 9.6 In addition, to the maximum extent permitted by law, each Participant expressly releases the Organiser, their sponsors and partners, as well as any other associated organization(s) responsible for sponsoring, fulfilling, administering, advertising, or promoting the Hackathon, and all of their respective past and present agents, officers, directors, employees, and representatives, from and against any and all claims that the Participant may have based on contract, tort, negligence or any other cause of action arising out of or in connection with:
    • The production, distribution, broadcast or exhibition of the Participant’s name, photograph, auto-visual footage, voice or other personal data;
    • The broadcast, transmission, performance, exploitation and/or use of Submissions or any part thereof, or any combination of the foregoing, including, without limitation, any claims of invasion of privacy, defamation, or violation of any IP Rights; or
    • Creation, submission or entry of a Submission, participation in the Hackathon, acceptance or use or misuse of the prize (including any travel- or activity- related thereto).
  • 9.7 Each Participant shall indemnify and hold harmless against the Organiser, their sponsors and partners, as well as any other associated organization(s) responsible for sponsoring, fulfilling, administering, advertising, or promoting the Hackathon, and all of their respective past and present agents, officers, directors, employees, and representatives, in full from and against all actions, proceedings, claims, damages, liabilities, settlement sums, charges, losses, costs and expenses (including without limitation, legal costs and expenses and costs of other professionals and any penalties or other amounts levied, imposed or charged by any regulator or regulatory authority) arising out of or in connection with:
    • Any claim or action by any third party for actual or alleged infringement of IP Rights in connection with any Submissions; and/or
    • Any breach or violation of any applicable laws by the Participants or any Submission.

Article 10. Privacy and Publicity

  • 10.1 The Organiser may collect and process personal data such as Participants’ names, email addresses, contact numbers, etc. as stated under Clause 3.1 when Participants provide the Organiser with such personal data directly, or when third parties collect and disclose such personal data to the Organiser. In addition, Participants may be filmed or photographed on the virtual platform(s) while participating in the Hackathon and the Organiser may collect photographs, audio-visual footage, comments, and any other record of Participants’ participation in the Hackathon.
  • 10.2 In accordance with the Organiser’s agreement with the Participant to participate in the Hackathon, the Organiser reserves the rights to collect, use, process, and disclose the Participants’ personal data in order to administer and conduct the Hackathon, to facilitate the use of the prizes, to attribute Participants as the inventors/authors of the invention/work that was created for the purpose of the Hackathon, and/or to administer the assignment of the rights in the Submission.
  • 10.3 As it is in the Organiser’s legitimate interest to promote the Hackathon, the Organiser may collect, use, and process the Participants’ personal data for the purposes of displaying publicly, archiving, and reproducing any personal data and/or Submissions for broadcast, marketing, publicity and promotional purposes without any payment to the Participants or the Participant’s prior consent. This includes, but is not limited to, posting or linking the Submission on the Event Website, as well as the Organiser’s proprietary social media channels and websites, and display and promotion of any Submission in any other media worldwide. If the Participant does not agree to the use of his/her photographs, audio-visual footage, comments, or Submissions for marketing and promotional purposes, the Participant should notify the Organiser promptly via email.
  • 10.4 Participants hereby consent and agree to the Organiser’s collection, use, processing, and disclosure of such personal data for the purposes set out in Clauses 10.2 and 10.3 above.
  • 10.5 When Participants submit information (including personal data) on a website or platform run by a third party in connection with the Hackathon, Participants’ information may be used by that third party in accordance with that third party's own Terms & Conditions and Privacy Policy. Participants will also be required to upload their Submissions onto or otherwise use other third-party systems or platforms. Such third-party websites, platforms, or systems are not affiliated with or owned, operated, or controlled by the Organiser, and do not act as data intermediaries to process personal data on the Organiser's behalf. The Organiser cannot and does not assume responsibility for the content, privacy policies, or practices (including practices relating to the use, collection, and disclosure of personal data) of such third parties. The Organiser therefore encourages all Participants to review the relevant Terms & Conditions and privacy policies governing the use of the relevant third party websites, platforms, or systems before submitting the Participants’ information or personal data to such third parties.
  • 10.6 By using the third-party websites, platforms, or systems, the Participants expressly relieve the Organiser from any and all liability in connection with:
    • Their access and use of such third party websites, platforms, or systems;
    • Any personal data submitted to such third party websites, platforms, or systems; and/or
    • The acts, omissions, or defaults of such third parties.
  • 10.7 By entering the Hackathon, Participants agree to participate in any media, promotional activity, or publicity related to the Hackathon without any form of payment or compensation, if requested to do so by the Organiser.
  • 10.8 Participants further agree to participate in, at their own expense, prize presentation ceremonies, media, promotional activity, or publicity related to the Hackathon in Singapore or elsewhere in relation to the Hackathon without any form of payment or compensation, if requested to do so by the Organiser.
  • 10.9 Participants acknowledge that the Organiser cannot control the information that the Participants disclose to the Organiser in the course of participating in the Hackathon, or what the Organiser will remember about the Submissions. Participants will not receive any compensation or credit from the Organiser for use of the Submission in connection with the Hackathon, save as expressly provided for under the Agreement. The Organiser is not responsible for any unauthorized use of the Submission by those accessing or viewing the Submission.
  • 10.10 The Organiser is not obligated to use any Submission for any purpose.

Article 11. General Terms

  • 11.1 The Organiser may modify any of the provisions stated within this Agreement at any point of time. Participants are responsible for checking the Event Website for any updates to the Agreement. A copy of the latest version of the Agreement is made available at the Event Website. By continuing to participate in the Hackathon, Participants signify their acceptance to any updates to the Agreement.
  • 11.2 The Organiser reserve the right to disqualify any Participant or Participant Team who:
    • Fails to comply with any of the provisions stated within this Agreement;
    • Cheats or tampers with the operation of the Hackathon; or
    • Engages in conduct that is unlawful, offensive, or otherwise leads the Organiser to conclude that public association with the Participant could cause controversy or generate any negative publicity for the Organiser or its partners.
  • 11.3 In the event that the administration, operation, and/or security of the Hackathon is impaired and/or compromised in any way, the Organiser may:
    • Suspend the Hackathon to address the impairment before assessing the possibility of resumption of the Hackathon;
    • Award the prize according to the judging criteria set forth above from among eligible entries received up to the time of impairment;
    • Extend any deadlines; or
    • Take any other reasonable action as deemed necessary and appropriate to the circumstances.
  • 11.4 Participants agree that the relationship between the Participants and the Organiser is not a confidential, fiduciary, or other special relationship.
  • 11.5 Entry to the Hackathon is personal to the Participant. No other person has any right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce the Participant's rights under the Agreement or enjoy any benefit of any prize.
  • 11.6 Failure on the part of the Organiser to enforce any term of the Agreement shall not constitute a waiver of any of the Organiser’s rights, and shall not affect the validity of any Terms & Conditions stated within this Agreement.

Article 12. Governing Law

  • 12.1 The construction, validity, interpretation and enforceability of the Agreement formed between the Organiser and any Participant accepting the stated Terms & Conditions, shall be governed by, and construed in accordance with the laws of Singapore, without giving effect to any choice of law or conflict of law rules.
  • 12.2 Except where prohibited, Participants agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Hackathon or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in Singapore.
